1. Belgian Warmblood vzw – BWP (hereafter: organiser) will organise a hybrid
auction, the BWP New Life Auction. The BWP New Life Auction will take place on
the 7 of March 2026. The hybrid auction takes place under the supervision of a civillaw
notary, assisted by the auctioneer appointed by BWP.
2. If one takes part in this auction, one agrees to these auction terms and agreements
explicitly and unconditionally. To take part in this hybrid auction, the buyer must
register himself at www.bwp.auction. By this registration, one agrees to these
auction terms and agreements.
3. The seller gives BWP the task to sell an embryo/a broodmare on account of the
seller applied by the general conditions.
4. The embryos and broodmares are accompanied by the necessary certificates.

5. Bidding and payments are made in euro.
6. The sale occurs by auction to the highest bidder by payment of the purchase price
and if needed VAT, and 12,5% commission surcharge (ex-VAT). The purchase is
made according to Belgian law. The auction terms and conditions are part of the
purchase agreement.
7. If an embryo is assigned, the legal risk transfers to the buyer. The buyer should
take out his own insurance for this risk. The seller stays owner of the embryo/the
broodmare until the full payment of all the invoices according to art. 8.
8. After the auction, the buyer will receive a settlement via email, together with two
invoices to be paid (one on the name of BWP and one in the name of the seller).
The invoice on the name of BWP includes the premium of 12,5%, increased by
VAT. If the seller is subject to VAT, they are mentioned on the auction website. The
invoices have to be paid before the due time mentioned on the invoice. In the case
of non-payment, an interest of 10% per year will be due in justice and without notice
of default. Moreover, a damage claim of 10% of the amount due, with a minimum of
65,00 will be charged.
9. When the natural mother herself carries her embryo, the mare, after payment of
both invoices, remains with the seller. The foal is born at the seller's premises. The
delivery of the foal cannot take place before the foal has reached the age of 150
days. When a surrogate mare carries the embryo, the surrogate mare moves to the
buyer after payment of both invoices. The surrogate mare remains the property of
the seller. The value of the broodmare is 4000 euro incl.VAT. It will be billed after
200 days from the birth of the embryo or expire when the surrogate mare is
returned. After prior notification, the surrogate mare shall be returned by the buyer
to the seller, in good health, dewormed and vaccinated, at the latest 6 months after
the birth of the foal. All costs of transporting the surrogate mare back to the seller
will be borne by the buyer. The foal always carries in its name the suffix of the
buyer's stable, unless otherwise agreed between the seller and the buyer.
10. The seller will deliver the broodmare/the surrogate dam/ foal to the buyer, provided
that the place of delivery is in Belgium. The modalities of delivery/collection shall be
arranged by the buyer directly with the seller.
11. The organiser is not liable for possible erroneous information in the catalogue or on
the website.
12. The organiser does not guarantee the gender of a sexed embryo. There is never
100% certainty about the gender of a sexed embryo.
13. In the case of export of a horse, the buyer will submit valid transport documents
within the year, on forfeiture of a penal sum consisting of the VAT as yet to be
charged.
14. The organisation will definitively decide on any disputes that may arise regarding
the sale during the auction procedure.
15. If after the auction a difference would arise regarding the sale, only the districtcourts
of Leuven, department of Leuven, are competent, The Belgian law is
applicable.
The English version of these auction conditions is a translation of the Dutch text. Only the
Dutch text has a binding effect in this respect. The translation of these auction conditions
into another language is purely informatory.
ADDENDUM
AUCTION CONDITIONS FOR ONLINE BIDDING AT THE BELGIAN WARMBLOOD
AUCTION
By making a bid via internet, the bidder accepts unconditionally the mentioned auction and sales
conditions, as well as the conditions below, which are also applicable to the BELGIAN
WARMBLOOD AUCTION ONLINE.
Auctioning party : Belgian Warmblood, Waversebaan 99, B-3050 Oud-Heverlee
Terms and conditions :
1. Every bid, expressed by a participant, is, just like a bid on the spot, irrevocable and
unconditional.
2. For determining if a bid in the auction has first been made by an internet participant or by a
bidder on the spot, the judgement of the auctioneer is binding.
3. Any participant is aware of the fact, and agrees with it, that the services offered by the auctioning
party are limited to technically facilitating a) following the BWP New Life Auction via internet and
b) participating in the BWP New Life Auction as a bidder.
4. The participant is aware of the fact, and explicitly agrees, that the services available via the
website are limited to making it technically possible to follow the auction and to participate in the
auction as a bidder. Belgian Warmblood - BWP vzw does not have or take any responsability in the
organization and the course of the auction via its website (for instance, and without wanting to be
limitative : the website drops out or reacts slowly during the auction). Belgian Warmblood - BWP
vzw takes every possible effort to secure its systems against loss of data and/or any form of
unlawful use, and takes the appropriate technical and organizational measures. In his/her contact
with Belgian Warmblood - BWP vzw the participant is obliged to adequatly secure his/her
computer and/or any other device used to have access to the auction site, and as usual to protect
them from virusses or other illegal programmes or sites which can be spread via internet.
5. When the participant in the auction makes a bid via the internet, that bid has equal legal effect as
a bid on the spot.
6. In order to be allowed to make a digital bid in the auction, the participant may be asked by the
auctioning party to transfer an internet security. In that case, the participant has to meet that request
before he can be accepted to participate.
7. By making a bid via internet, the participant declares to know the procedure of deposit,
securing and release of the internet deposit and declares to accept that procedure.
8. If the participant is, for whatever reason, not capable of meeting his obligation to take possession
of the auction object, the caused damage will be recovered from him by the auctioning party, in the
first place, but not exclusively, from an internet deposit.
9. The participant declares to possess a mobile phone with which sms-messages can be received.
During the auction, the participant must be attainable for the auctioneer, the auctioning party and
the auction organizer.
10. The auction organization reserves the right to give up the implementation of a specific auction
via internet, for whatever reason and at any moment.
11. The auction organization has the competence to modify this registration declaration. The
participant will every time have the right to refuse the altered stipulations. In that case, the
auctioning party has the right to directly stop its service to the participant. From that moment, the
participant will no longer be able to participate in auctions (via internet).
12. When the participant wants a service which causes an unusual transaction in the sense of Wwft,
the auction organization, the auctioning party and/or the auction has the obligation to communicate
that to a central reporting. It is not permitted to communicate that to the participant.
DECLARATION CONCERNING THE AVAILABILITY OF PERSONAL DATA
The personal data communicated by the participant may only be used for the above mentioned
registration which allows to take part in bidding via internet. The auctioning party, and also the
notaries involved in an auction, can ask for and have insight in all data made available by the
participant. The above mentioned personal data of the participant may only be passed on to third
parties in so far as this is necessary for bidding in the auction. The above mentioned personal data
of the participant may not be sold, let or otherwise given to third parties. The participant gives his
consent for the visibility of his data to all collaborators of the auctioning party and other parties
connected to the internet bidding system
1. Belgian warmblood – BWP vzw, (hierna ook genoemd als "organisator") organiseert een
hybrideveiling, de BWP New Life Auction. De BWP New Life Auction vindt plaats op 7 maart
2026. De hybrideveiling staat onder toezicht van een gerechtsdeurwaarder, bijgestaan door
de veilingroeper aangewezen door BWP.
2. Het deelnemen aan deze veiling impliceert de uitdrukkelijke en voorbehoudloze kennisname
en aanvaarding van onderhavige veiling- en verkoopsvoorwaarden. Om te kunnen
deelnemen aan de hybrideveiling dient de koper zich vooraf te registeren via het
veilingplatform van www.bwp.auction Door deze registratie aanvaardt hij onvoorwaardelijk
deze veiling- en verkoopsvoorwaarden.
3. De verkoper geeft BWP de opdracht om het embryo/de fokmerrie te verkopen voor rekening
van de koper en dit conform onderhavige veiling- en verkoopsvoorwaarden. BWP treedt
derhalve op als veilingdienst en als tussenpersoon tussen verkoper en koper.
4. De embryo’s en fokmerries zijn vergezeld van de nodige attesten.(embryo – fokmerrie +
dracht)
5. De biedingen en betalingen geschieden in euro.
6. De verkoop komt tot stand volgens Belgisch recht bij opbod en toewijzing aan de hoogste
bieder na betaling van de koopprijs, al dan niet te verhogen met BTW, en opgeld ad 12,5%
(exclusief BTW). De veiling- en verkoopsvoorwaarden maken integraal deel uit van de
verkoopovereenkomst.
7. Bij de toewijzing van het embryo/de fokmerrie, gaat het risico over op de koper. De koper
dient voor dit risico zelf een verzekering af te sluiten. De verkoper blijft evenwel eigenaar van
het embryo/de fokmerrie tot de volledige betaling van de te vereffenen sommen conform de
art. 8 hierna opgestelde facturen.
8. De koper zal na de veiling per e-mail een afrekening ontvangen, samen met de twee te
vereffenen facturen (een op naam van BWP en een op naam van de verkoper). De factuur
op naam van BWP brengt het opgeld ad 12,5% op de toewijzingsprijs (meer BTW) in
rekening. Indien de verkoper BTW-onderworpen is, zal de verkoopfactuur de toewijzingssom
verhoogd met de BTW omvatten. Op de website staat vermeld wanneer de verkoper BTWonderworpen
is. De facturen dienen betaald te worden op de vervaldatum vermeld op de
factuur. Bij niet betaling zal van rechtswege en zonder ingebrekestelling een intrest
verschuldigd zijn gelijk aan 10% per jaar. Tevens zal een schadebeding aangerekend
worden van 10% van het verschuldigde bedrag met een minimum van 65,00 euro.
9. Wanneer de natuurlijke moeder zelf haar embryo draagt, blijft de merrie, na betaling van
beide facturen, bij de verkoper. Het veulen wordt geboren bij de verkoper. De levering van
het veulen kan niet geschieden voordat het veulen de leeftijd van 150 dagen heeft bereikt.
Wanneer een draagmerrie het embryo draagt, verhuist de draagmerrie na betaling van beide
facturen naar de koper. De draagmerrie blijft eigendom van de verkoper. De waarde van de
draagmerrie bedraagt 4000 euro incl.BTW. Deze wordt gefactureerd na 200 dagen na
geboorte van het embryo of vervalt bij het terugbrengen van de draagmerrie. De draagmerrie
wordt, na voorafgaandelijke verwittiging, uiterlijk 6 maanden na de geboorte van het veulen
door de koper teruggebracht naar de verkoper, in goede gezondheid, ontwormd en
gevaccineerd. Alle kosten voor het vervoer van de draagmerrie terug naar de verkoper zijn
voor rekening van de koper. Het veulen draagt in zijn of haar naam telkens de suffix van de
stal van de koper, tenzij anders overeengekomen tussen de verkoper en de koper.
10. De verkoper zal de fokmerrie/draagmoeder/het veulen bij de koper leveren, in zoverre de
plaats van levering zich in België bevindt. De modaliteiten omtrent het leveren/afhalen, dient
de koper rechtstreeks met de verkoper te regelen.
11. De organisator is niet aansprakelijk voor eventuele foutieve info in de cataloog of op de
website.
12. De organisator biedt geen garantie voor het geslacht van een gesexed embryo. Er is nooit
100% zekerheid over het geslacht van een gesexed embryo.
13. In geval van export zal de koper binnen het jaar een geldig exportdocument voorleggen op
straffe van het alsnog in rekening brengen van de verschuldigde BTW
14. BWP beslecht in laatste instantie alle betwistingen die tijdens de veilingverrichtingen nopens
de verkoop zouden kunnen ontstaan.
15. Indien na de veiling een geschil zou ontstaan betreffende de verkoop, zijn alleen de
rechtbanken ressorterend onder het gerechtelijk arrondissement Leuven, afdeling Leuven
bevoegd. Het Belgische recht is van toepassing.
ADDENDUM
VEILINGVOORWAARDEN BELGIAN WARMBLOOD AUCTION ONLINE
Door het uitbrengen van een bieding via internet aanvaardt de Bieder de voorstaande veiling en
verkoopsvoorwaarden, evenals onderstaande voorwaarden eveneens van toepassing op de
BELGIAN WARMBLOOD AUCTION ONLINE onvoorwaardelijk:
Veilende partij: Belgian Warmblood, Waversebaan 99, B-3050 OUD-HEVERLEE
Voorwaarden:
1. Elk door de Deelnemer uitgebracht bod is, net zoals geldt voor een bieder in de zaal,
onherroepelijk en onvoorwaardelijk.
2. Voor het bepalen of een bod in de veiling eerst is uitgebracht door de Deelnemer (via internet) of
een bieder uit de zaal, is het oordeel van de veilingmeester bindend.
3. Deelnemer is zich ervan bewust en stemt er mee in dat de door de veilende partij geleverde
diensten beperkt zijn tot het technisch faciliteren van a) het via internet volgen van de BWP New
Life Auction en b) het als bieder participeren in de BWP New Life Auction.
4. De deelnemer is zich er van bewust en stemt er uitdrukkelijk mee in dat de via de website
beschikbare diensten beperkt zijn tot het technisch mogelijk maken van het via het internet volgen
van de veiling en het als bieder participeren aan de veiling. Belgian Warmblood – BWP vzw heeft
en neemt geen enkele verantwoordelijkheid voor de organisatie en het verloop van de veiling via
haar website (bijvoorbeeld en zonder limitatief te willen zijn: het uitvallen van de website tijdens de
veiling of de vertraging van de werking van de website tijdens de veiling). Belgian Warmblood –
BWP vzw stelt alles in het werk om haar systemen te beveiligen tegen verlies van gegevens en / of
tegen enige vorm van onrechtmatig gebruik en treft hiertoe passende technische en organisatorische
maatregelen. In zijn omgang met Belgian Warmblood – BWP vzw is de deelnemer verplicht om de
computer en / of elk ander apparaat dat hij / zij gebruikt om toegang te krijgen tot de veilingwebsite
adequaat te beveiligen, en zoals gebruikelijk te beschermen tegen virussen of andere onwettige
programma's of bestanden die kunnen verspreid via internet.
5. Wanneer de Deelnemer op de Veiling overgaat tot het doen van een bieding via internet, heeft
deze bieding gelijke rechtskracht als het doen van een bieding in de zaalveiling.
6. Om digitaal mee te kunnen bieden op een veiling kan de Deelnemer gevraagd worden een
internetborg te storten op verzoek van de veilende partij. Deelnemer dient in dit geval te voldoen
aan het verzoek tot borgstelling voordat de deelnemer wordt goedgekeurd voor deelname.
7. De Deelnemer verklaart met het uitbrengen van een bieding via internet bekend te zijn met de
procedure voor storten, vastzetten en vrijgave van de internetborg en verklaart de hierop betrekking
hebbende procedure te aanvaarden.
8. Indien Deelnemer om welke reden dan ook niet in staat is aan zijn verplichting tot afname van
het veilingobject te voldoen, zal de ontstane schade door de veilende partij op de Deelnemer
worden verhaald, allereerst, maar niet uitsluitend, op een eventueel gestorte internetborg.
9. De Deelnemer verklaart te beschikken over een mobiele telefoon waarmee sms-berichten kunnen
worden ontvangen. Deelnemer dient gedurende de veiling bereikbaar te zijn voor de veilingmeester,
de veilende partij alsmede de veilingorganisatie.
10. De veilingorganisatie behoudt zich het recht voor om, om welke reden dan ook, op enig moment
af te zien van het via internet beschikbaar stellen van een specifieke veiling.
11. De veilingorganisatie heeft de bevoegdheid deze registratieverklaring te wijzigen. Deelnemer
zal telkens het recht hebben de gewijzigde bepalingen te weigeren. In dat geval heeft de veilende
partij het recht om haar dienstverlening jegens Deelnemer per ommegaande te staken. Deelnemer
zal vanaf dat moment dus niet meer (via internet) deel kunnen nemen aan veilingen.
12. Wanneer de Deelnemer een dienst verlangt die een ongebruikelijke transactie in de zin van de
Wwft oplevert, is de veilingorganisatie, de veilende partij en/of de Veiling verplicht dat te melden
bij een centraal meldpunt. Het is niet toegestaan de Deelnemer van deze melding op de hoogte te
brengen.
VERKLARING INZAKE BESCHIKBAARHEID PERSOONLIJKE GEGEVENS
De door de Deelnemer aangeleverde persoonlijke gegevens mogen alleen worden gebruikt ten
behoeve van de hiervoor bedoelde registratie die het mogelijk maakt via internet mee te kunnen
bieden. De veilende partij, alsmede bij een veiling betrokken notarissen mogen alle door de
Deelnemer beschikbaar gestelde gegevens opvragen en inzien. De hiervoor vermelde
persoonsgegevens van de Deelnemer mogen slechts aan derden worden verstrekt voor zover dit
nodig is in het kader van het bieden op de veiling. De hiervoor genoemde persoonsgegevens van de
Deelnemer mogen niet aan derden worden verkocht, verhuurd of anderszins in gebruik worden
gegeven. De Deelnemer geeft toestemming voor de zichtbaarheid van zijn gegevens aan alle
medewerkers van de veilende partij en andere partijen die zijn aangesloten bij het
internetbiedsysteem.
